Do I need a Commercial EPC if the building is not heated ?

We get asked this question frequently. The commercial EPC law stipulates that if a commercial property has a heating systems or cooling system in place it will require a commercial EPC. It will also require an EPC if the property has mechanical ventilation e.g extract fan(s). i.e If the building uses energy to condition the indoor climate it will need an commercial EPC prior to it being marketed.

We beleive the property market is now picking up in terms of an increased number of properties being put onto the market for let/sale (thus requiring an EPC or HIP). Properties are now begining to move with more realistic house prices.

What are the exemptions for a commercial EPC?

Under current commercial EPC law, an EPC is not required on the following exempt premises:

  • On lease renewals or extensions that were in place prior to 1st October 2008
  • Places of worship
  • Stand alone buildings less than 50 square meters
  • Properties with consent to be demolished within a 2 year period

Who is responsible for checking whether a commercial EPC is present?

Professional property agents will usually ask whether a commercial EPC is provided before they market a property. The purchasers/prospective leaseholders solicitor will also certainly ask to see the commercial EPC before contracts can be exchanged.

The official responsibility for the checking of the presence of a commercial EPC lies with Trading Standards who police and enforce the relevant penalty fines for non-compliance.
