Landlord Legal requirements

Anyone who lets a residential accommodation as a business activity is required by law to ensure the equipment they supply as part of the tenancy is safe.

The Electrical Equipment (Safety) Regulations 1994 requires that all mains electrical equipment (cookers, washing machines, kettles, etc), new/second-hand, supplied with the accommodation must be safe. Landlords therefore need to regularly maintain the electrical equipment they supply to ensure it is safe.

It is strongly advised to have the equipment checked before the start of each let. It would be good practice to have the equipment checked at regular intervals thereafter.

At every opportunity we offer our new and existing clients FREE EPC legislative advice as to whether their own property requires an EPC or is exempt. The current EPC law stipulates clearly the following:

“As soon as a building is in the process of being offered for sale, it is the responsibility of the seller to make available an EPC to prospective buyers”

“As soon as a building is in the process of being offered to let, it is the responsibility of the prospective landlord to make available an EPC to prospective tenants”

Any breach of the above is putting the responsible person(s) at risk of an enforceable penalty.
