			<content:encoded><![CDATA[<p>A recent discussion by an environmental group around energy performance certificates has urged that homes with an <acronym title="Energy Performance Certificate">EPC</acronym> rating below D should be banned from being marketed for sale/let unless they have been improved.</p>
<p>In response to the latter a senior executive at the Energy Saving Trust has backed this up by stating<em> &#8216;the move would force householders to refurbish their properties.&#8217; </em>Furthermore, they proposed in making it a planning condition to retrofit the whole house when householders seek planning permission to alter their own homes.</p>
<p>We believe that if the above procedures are put into place there needs to be clear direction by the the government/local authorities to guide home owners to competent companies/persons who can assist in terms of recommending measures to enhance a properties energy rating to comply.</p>

			<content:encoded><![CDATA[<p>We have been contacted by a number of Accreditation bodies in relation to <acronym title="Energy Performance Certificate">EPC</acronym> legislation enforcement urging energy assessors to assist in reporting incidents to Trading Standards, the CLG and the local regions MP -Where properties are being marketed for let or sale without an <acronym title="Energy Performance Certificate">EPC</acronym>.</p>
<p>At every opportunity we offer our new and existing clients FREE <acronym title="Energy Performance Certificate">EPC</acronym> legislative advice as to whether their own property requires an <acronym title="Energy Performance Certificate">EPC</acronym> or is exempt. The current <acronym title="Energy Performance Certificate">EPC</acronym> law stipulates clearly the following:</p>
<p><em>“As soon as a building is in the process of being offered for sale, it is the responsibility of the seller to make available an <acronym title="Energy Performance Certificate">EPC</acronym> to prospective buyers”</em></p>
<p><em>“As soon as a building is in the process of being offered to let, it is the responsibility of the prospective landlord to make available an <acronym title="Energy Performance Certificate">EPC</acronym> to prospective tenants”</em></p>
<p>Any breach of the above is putting the responsible person(s) at risk of an enforceable penalty.</p>
